Tryb udzielania zamówienia / Contract award procedure
Postępowanie o udzielenie zamówienia jest prowadzone w trybie zapytania ofertowego zgodnie z art. 2 ust. 1 pkt 1 ustawy Prawa zamówień publicznych.
The contract award procedure is conducted in the form of a request for quotation in accordance with Art. 2 clause 1 point 1 of the Public Procurement Law.

1.Przedmiotem zamówienia jest wykonanie specjalistycznych badań naukowych skupionych na kryptografii niezależnej od urządzeń zorientowana na eksperymenty, w szczególności na stworzeniu opisu matematycznego systemu kryptograficznego polegającego na dowolnej liczbie ustawień pomiarowych w obecności ataków oślepiających detektor. Badania naukowe prowadzone są w ramach realizacji projektu QuantEra/2/2020 finansowanego przez Narodowe Centrum Badań i Rozwoju.
The subject of the contract is the performance of specialized scientific focused on Implementation-oriented Device Independent CrypTography, in particular, in preparing a mathematical description for a cryptographic system involving arbitrary number of measurement setting in the presence of detector blinding attacks. Scientific research is carried out as part of the implementation of the QuantEra / 2/2020 project financed by the National Center for Research and Development.
2. Przedmiot zamówienia musi zostać wykonany z uwzględnieniem najwyższych europejskich standardów jakości prowadzenia badań naukowych opisanych w „The European Code of Conduct for Research Integrity”, dokument dostępnym pod adresem:
https://ec.europa.eu/research/participants/data/ref/h2020/other/hi/h2020-ethics_code-of-conduct_en.pdf, a finalny raport musi być pełnowartościowy (autorski, niepowtarzalny, przedstawiać nowy wkład do wiedzy w danej dziedzinie), wolny od wszelkich wad prawnych.
The subject of the contract must be performed taking into account the highest European quality standards for conducting scientific research described in „The European Code of Conduct for Research Integrity”, available from: https://ec.europa.eu/research/participants/data/ref/h2020/other/hi/h2020-ethics_code-of-conduct_en.pdf, and the final report must be full-fledged (original, unique, present a new contribution to knowledge in a given field) and free from any legal defects.
3. Zamawiający dopuszcza przygotowywanie raportu (powstającego w ramach realizowanego zlecenia) jedynie w języku angielskim.
The Awarding Entity accepts to prepare of the report (developed as part of the contract) only in the English language.
- Zgodnie z warunkami umowy o finansowanie, o udzielenie zamówienia mogą ubiegać się Wykonawcy, którzy posiadają niezbędną wiedzę i doświadczenie w zakresie przedmiotu zamówienia (osoby fizyczne) tj. Wykonawca musi spełniać łącznie wszystkie niżej wymienione warunki:
- posiadać tytuł magistra nauk fizycznych,
- posiadać status doktoranta (preferowana dziedzina: fizyka lub inne nauki ścisłe)
- posiadać znajomość j. angielskiego na poziomie co najmniej zaawansowanym (poziom języka zostanie zweryfikowany podczas rozmowy kwalifikacyjnej).
- In accordance with the terms of the financing agreement, Contractors that may participate in the contract award procedure are those who have the necessary knowledge and experience in the field of the subject of the contract (natural person), i.e., the Contractor must meet all of the following conditions jointly:
- have a master's degree in physics,
- have the status of a doctoral student (preferred field: physics or other exact sciences)
- have at least an advanced level of English (the language level will be verified during the interview).
- Ocena spełnienia warunków udziału w postępowaniu będzie dokonana poprzez sprawdzenie czy złożone przez Wykonawcę dokumenty i oświadczenia potwierdzają spełnienie poszczególnych warunków udziału w postępowaniu, zgodnie z formułą „spełnia - nie spełnia”. Z załączonych dokumentów powinno wynikać w sposób jednoznaczny, że Wykonawca te warunki spełnia.
Assessment of compliance with the above conditions will be made in accordance with the formula “meets - does not meet”, based on information contained in the documents listed above. The content of the attached documents must clearly show that the abovementioned conditions are met by the Contractor.
- W przypadku przedłożenia niekompletnej dokumentacji dot. potwierdzenia spełnienia warunku udziału w postępowaniu, Zamawiający może wezwać Wykonawcę do ich uzupełnienia, jeśli Wykonawca nie uzupełni dokumentacji w oznaczonym terminie ofertę uznaje się za niekompletną a warunek za nie spełniony.
In the event of submitting incomplete documentation regarding confirmation of the fulfillment of the condition for participation in the contract award procedure, the Contracting Authority may request the Contractor to supplement them, if the Contractor fails to complete the documentation within the specified deadline, the offer is deemed incomplete and the condition is not met.
- Niespełnienie chociażby jednego z ww. warunków skutkować będzie wykluczeniem Wykonawcy z postępowania. Wykluczenie Wykonawcy z postępowania może nastąpić na każdym etapie postępowania o udzielenie zamówienia.
Failure to meet even one of the abovementioned conditions will result in the Contractor’s exclusion from the procedure. The Contractor may be excluded from the procedure at any stage of the contract award procedure.
- Z postępowania o udzielenie zamówienia wyklucza się Wykonawców, którzy:
- nie spełniają warunków udziału w postępowaniu;
- nie spełniają warunków udziału w postępowaniu dotyczących przedłożenia wymaganej dokumentacji (oferta niekompletna);
- złożyli ofertę po terminie;
- wykonywali czynności bezpośrednio związane z przygotowaniem prowadzonego postępowania lub posługiwali się w celu sporządzenia oferty osobami uczestniczącymi w dokonywaniu tych czynności, chyba że udział tych Wykonawców nie utrudni uczciwej konkurencji;
- złożyli nieprawdziwe informacje mające wpływ na wynik prowadzonego postępowania.
- Excluded from the contract award procedure shall be Contractors who:
- do not meet the conditions;
- do not meet the conditions for participation in the contract award procedure regarding the submission of the required documentation (incomplete offer);
- submitted an offer after the deadline;
- performed activities directly related to the preparation of the contract award procedure or used to prepare the offer with persons participating in these activities, unless the participation of these contractors does not hinder the fair competition;
- submitted false information affecting the outcome of the contract award procedure.
- Z postępowania o udzielenie zamówienia wyklucza się również:
- Wykonawców, o których mowa w art. 7 ust. 1 wymienionych w wykazach określonych w rozporządzeniu 765/2006 i rozporządzeniu 269/2014 albo wpisanych na listę, na podstawie decyzji w sprawie wpisu na listę rozstrzygającej o zastosowaniu środka, o którym mowa w art. 1 pkt 3 ustawy z dnia 13 kwietnia 2022 r. o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę (Dz. U. poz. 835);
- Wykonawców, których beneficjentem rzeczywistym w rozumieniu ustawy z dnia 1 marca 2018 r. o przeciwdziałaniu praniu pieniędzy oraz finansowaniu terroryzmu (Dz. U. z 2022 r. poz. 593 i 655) jest osoba wymieniona w wykazach określonych w rozporządzeniu 765/2006 i rozporządzeniu 269/2014 albo wpisana na listę lub będąca takim beneficjentem rzeczywistym od dnia 24 lutego 2022 r., o ile została wpisana na listę na podstawie decyzji w sprawie wpisu na listę rozstrzygającej o zastosowaniu środka, o którym mowa w art. 1 pkt 3 ustawy z dnia 13 kwietnia 2022 r. o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę (Dz. U. poz. 835);
- Wykonawców, których jednostką dominującą w rozumieniu art. 3 ust. 1 pkt 37 ustawy z dnia 29 września 1994 r. o rachunkowości (Dz. U. z 2021 r. poz. 217, 2105 i 2106) jest podmiot wymieniony w wykazach określonych w rozporządzeniu 765/2006 i rozporządzeniu 269/2014 albo wpisany na listę lub będący taką jednostką dominującą od dnia 24 lutego 2022 r., o ile został wpisany na listę na podstawie decyzji w sprawie wpisu na listę rozstrzygającej o 5 / 10 zastosowaniu środka, o którym mowa w art. 1 pkt 3 ustawy z dnia 13 kwietnia 2022 r. o szczególnych rozwiązaniach w zakresie przeciwdziałania wspieraniu agresji na Ukrainę (Dz. U. poz. 835).
- The following shall also be excluded from the procurement procedure:
- Contractors referred to in Article 7 (1) listed in the lists specified in Regulation 765/2006 and Regulation 269/2014 or included in the list, on the basis of a decision on inclusion in the list ruling on the application of the measure referred to in Article 1 (3) of the Act of 13 April 2022 on specific solutions for counteracting support for aggression against Ukraine (Journal of Laws, item 835);
- Contractors whose beneficial owner within the meaning of the Act of 1 March 2018 on antimoney laundering and counter-terrorist financing (Journal of Laws of 2022, items 593 and 655) is a person listed in the lists set out in Regulation 765/2006 and Regulation 269/2014 or listed or being such a beneficial owner as of 24 February 2022, provided that he or she has been included in the list on the basis of a decision on inclusion in the list resolving the measure referred to in Article 1(3) of the Law of 13 April 2022 on specific solutions for counteracting support for aggression against Ukraine (Journal of Laws, item 835);
- Contractors whose parent company within the meaning of Article 3 (1) (37) of the Accounting Act of 29 September 1994 (Journal of Laws of 2021, item 217, 2105 and 2106) is an entity listed in the lists set out in Regulation 765/2006 and Regulation 269/2014 or listed or being such a parent company as of 24 February 2022, provided that it has been included in the list on the basis of a decision on inclusion in the list deciding on the application of the measure referred to in Article 1, point 3 of the Law of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine (Journal of Laws, item 835).
- Ofertę należy przygotować na formularzu stanowiącym Załącznik 1 do Zapytania Ofertowego „Formularz Oferty”.
The offer must be prepared using the form which constitutes Appendix 1 of the Request for offers - “Offer Form”.
- Treść złożonej oferty musi odpowiadać treści Zapytania Ofertowego oraz zawierać wszystkie wymagane załączniki. Do oferty należy dołączyć:
- oświadczenie Wykonawcy potwierdzające spełnianie warunków wskazanych w punkcie III zapytania ofertowego (wg wzoru stanowiącego Załącznik nr 2 do Zapytania ofertowego);
- dokumenty (skany lub potwierdzone za zgodność z oryginałem kopie) potwierdzające kwalifikacje posiadane przez osobę wskazaną przez Wykonawcę do realizacji przedmiotu zamówienia, w szczególności :
- CV;
- Dyplom magistra nauk fizycznych;
- certyfikat potwierdzający poziom znajomości języka angielskiego (opcjonalnie);
- inne wymagane prawem dokumenty (skany lub potwierdzone za zgodność z oryginałem kopie) – jeżeli dotyczy;
- pełnomocnictwo do złożenia oferty w oryginale lub uwierzytelnionej kopii, w przypadku kiedy oferta w imieniu Wykonawcy została podpisana przez pełnomocnika - jeżeli dotyczy.
- The content of the submitted offer must be consistent with the Request for offers and it must include all of the required documents and declarations indicated in the Section III. The Contractor shall submit with the offer:
- A declaration of the compliance with the requirements indicated in Section III, which constitutes Appendix 2 of the Request for offers;
- Documents (scans or certified true copies) confirming the qualifications held by the person indicated by the Contractor to perform the subject of the contract, in particular:
- a CV;
- a master degree in physics (diploma);
- a certificate confirming level of English (optional);
- Other documents required by law (scans or certified true copies)- if applicable.
- A power-of-attorney for submitting an original or certified copy of the offer, where the offer has been signed by an attorney-in-fact on behalf of the Contractor - if applicable.
- Oferta wraz z załącznikami musi zostać podpisana przez osobę uprawnioną do reprezentowania Wykonawcy.
The offer must be signed by a person authorized to represent the Contractor.
- Ofertę należy przygotować w języku polskim lub angielskim.
The offer should be prepared in Polish or English.
- Cena może być podana w złotych polskich (PLN) lub w innej walucie niż PLN. Jeśli cena podana w ofercie będzie wyrażona w innej walucie niż złoty polski to zostanie ona przeliczona przy zastosowaniu średniego kursu sprzedaży ogłaszanego przez NBP, obowiązującego w dniu otrzymania oferty.
The price may be given in Polish zlotys (PLN) or any currency other than PLN. If the price given in the offer is expressed in a currency other than the Polish zloty, it will be converted according to the average selling rate announced by the National Bank of Poland in force on the day the offer is received.
- Cena musi być podana liczbowo, do dwóch miejsc po przecinku oraz słownie.
The price must be expressed numerically with the accuracy of up to two decimal places and in words.
- Podana cena musi obejmować wszystkie koszty realizacji zamówienia z uwzględnieniem wszystkich opłat i podatków (w tym od towarów i usług). W przypadku osób fizycznych realizujących przedmiot zamówienia na podstawie umowy cywilno-prawnej zawartej bezpośrednio z Zamawiającym, podana cena powinna uwzględniać całkowity koszt brutto umowy cywilno-prawnej.
The price must include all the costs of the contract including all fees and taxes (including goods and services). In the case of natural persons performing the subject of the contract on the basis of a civil law contract concluded directly with the Awarding Entity, the total price should take into account the total gross cost of the civil law contract.
- Wykonawca ponosi wszelkie koszty związane z przygotowaniem i złożeniem oferty.
The Contractor shall bear all the costs related to the preparation and submission of the offer.
- Wykonawca przed upływem terminu składania ofert może zmienić lub wycofać złożoną ofertę.
Before the expiration of the deadline for the offer submission, the Contractor may amend or withdraw the submitted offer.
- Wykonawca pozostaje związany ofertą przez okres 30 dni począwszy od dnia upływu terminu składania ofert. Termin związania ofertą może ulec wydłużeniu, za zgodą Zamawiającego.
The offer shall be valid for 30 days starting from the date of the offer submission deadline. The offer binding period may be extended with the consent of the Awarding Entity.
- Zamawiający zastrzega sobie prawo do poprawienia w ofercie oczywistych omyłek pisarskich, oczywistych omyłek rachunkowych z uwzględnieniem konsekwencji rachunkowych dokonanych poprawek, niepowodujących istotnych zmian w treści oferty. Zamawiający nie będzie dokonywał poprawy podanej w ofercie „Ceny całkowitej brutto”.
The Awarding Entity reserves the right to correct obvious spelling mistakes in the offer, as well as obvious calculation errors, taking into consideration the calculation consequences of the corrections made, provided that they do not significantly alter the content of the offer. The Awarding Entity shall not correct the “Gross total price” quoted in the offer.
- Zamawiający zastrzega możliwość, w każdym czasie przed upływem terminu składania ofert, wprowadzenia zmian lub uzupełnienia Zapytania Ofertowego. W takim przypadku informacja o wprowadzonych zmianach lub uzupełnieniach wraz ze wskazaniem daty upublicznienia zmiany i opisu dokonanych zmian lub uzupełnień, zostanie niezwłocznie zamieszczona w miejscu publikacji Zapytania Ofertowego.
The Awarding Entity reserves the right to amend or supplement the Request for offers at any time before the lapse of the offer submission deadline. In such an event, the Awarding Entity shall promptly publish a notice of the amendments or supplements made, providing the date of announcement of the changes and a description of such changes or supplements, at the site of the publication of the Request for offers.
- W przypadku gdy zakres wprowadzonych do Zapytania Ofertowego powodować będzie konieczność modyfikacji ofert, Zamawiający przedłuży termin składania ofert.
Where the scope of the changes introduced into the Request for offers result in the need to modify the offer, the Awarding Entity shall extend the offer submission deadline.
- Zamawiający zastrzega sobie prawo do odwołania lub unieważnienia postępowania ofertowego w dowolnym terminie bez podania przyczyny.
The Awarding Entity reserves the right to recall or cancel the contract award procedure at any time without giving a reason.
- Przy wyborze najkorzystniejszej oferty, Zamawiający kierować się będzie jedynym kryterium oceny ofert tj.: Cena całkowita brutto, biorąc pod uwagę cenę całkowitą za realizację przedmiotu zamówienia przedstawioną przez Wykonawcę w Formularzu oferty.
In selection the best offer the Awarding Entity shall evaluate the “Gross total price” criterion for the total gross prices of the subject of the contract supplied by the Contractor in the Offer Form.
- Wartość punktowa w niniejszym kryterium zostanie obliczona w następujący sposób: liczba pkt oferty ocenianej = [(cena najniższej oferty) / (cena oferty ocenianej)] x 100
The score for this criterion shall be calculated as follows: score granted to the evaluated offer = [(Lowest offer price) / (Evaluated offer price)] x 100
- Punktacja będzie podawana z dokładnością do dwóch miejsc po przecinku.
The score will be expressed with the accuracy of up to two decimal places.
- W wyniku dokonanej oceny wg kryteriów wskazanych w ust. 1, oferta może otrzymać maksymalnie 100 punktów.
As a result of the evaluation, according to the criterion indicated in the clause 1 above, the offer may receive the score of maximum 100 points.
- Za najkorzystniejszą ekonomicznie i jakościowo zostanie uznana oferta, która nie podlega odrzuceniu oraz w toku oceny uzyska największą liczbę punktów.
The most economic and best quality offer shall be the one which has not been excluded from the procedure and which receives the highest score during the evaluation.
- W przypadku przedstawienia takiej samej najniższej ceny, przez co najmniej dwóch Wykonawców, zostaną oni wezwani do ponownego przedstawienia oferty z nową ceną przedmiotu zamówienia.
If at least two Contractors submit the same lowest price, they will be called to submit a new offer, with a new price for the subject of the contract.
- Zamawiający udzieli zamówienia Wykonawcy, którego oferta uzyskała najwyższą̨ liczbę̨ punktów.
The Awarding Entity shall award the contract to the Contractor whose offer received the highest score during the evaluation process.
- O wyborze najkorzystniejszej oferty Zamawiający zawiadomi Wykonawców elektronicznie na adres e-mail, z którego została przesłana oferta lub na adres e-mail wskazany w ofercie.
The Awarding Entity will notify Contractors who have been awarded the contract electronically to the e-mail address from which the offer was sent or to the e-mail address indicated in the offer.
- Termin realizacji przedmiotu zamówienia ustala się na okres od dnia podpisania umowy do 30 czerwca 2024 r. Zamawiający zastrzega sobie prawo do zmiany terminu realizacji przedmiotu zamówienia. Nowe terminy będą ustalane w konsultacji z wyłonionym Wykonawcą.
The deadline for performing the subject of the contract was set for the period from the date of signing the contract to June 30, 2024 . The Awarding Entity reserves the right to change the date of the subject of the contract. The new date will be determined in agreement with the selected Contractor.
- Oferta wraz z załącznikami powinna być przesłana za pośrednictwem poczty elektronicznej na adres: ictqt-careers@ug.edu.pl.
The offer and attachments should be sent via e-mail to the address ictqt-careers@ug.edu.pl.
- Termin składania ofert upływa dnia: 06.07.2023 r. (CEST).
The offer submission deadline shall expire on the 6th July 2023 (CEST).
- Za dzień złożenia oferty uznaje się termin wpływu oferty na adres e-mail Zamawiającego
The submission date shall be deemed to be the date when the offer is received at the Awarding Entity’s email address.
- Oferty złożone po terminie składania ofert nie będą rozpatrywane.
Offers submitted past the offer submission deadline shall not be considered.
- Zamawiający zastrzega sobie możliwość wydłużenia terminu składania ofert. W takim przypadku Zamawiający każdorazowo zamieści stosowną informację w miejscu publikacji Zapytania Ofertowego.
The Awarding Entity reserves the right to extend the offer submission deadline. In such an event, the Awarding Entity shall each time publish a relevant notice at the site of the publication of Request for offers.
